Mr Ma was previously allowed to change his plea to not guilty after a different judge found that his original plea of guilty was involuntary, given after legal advice which he alleges was conflicted. Following trial, he was convicted by a jury of trafficing 1.185kg of cocaine and is sentenced to 23 years in jail. Justice Andrew Chan mentions that the allegation against his former legal representative of perverting the course of justice is "still under the police investigation and to a certain extent not directly relevant to the drug offence".

Mr Ma succeeds in his application to change his plea to not guilty, after changing his legal team, whom he alleges had a conflict of interest in getting him to make a statement admitting guilt and clearing the other accused, Mr Hung Chi Him. They deny this. Ma had previously given a video-recorded interview which is contradicted by the statement. Justice Judianna Barnes finds that his plea of guilty was entered involuntarily.
