Mr Ma succeeds in his appeal and his conviction is quashed. It emerges that the solicitors' clerk who originally advised him to plead guilty (a plea which he successfully withdrew) has convictions for rape, burglary and blackmail, amongst other things.

Following the second trial, Mr Chan's conviction for murder is again quashed, this time because, although he admitted the killing, Judge Anthea Pang Po Kam failed to direct the jury on the partial defence of provocation and the alternative verdict of manslaughter. A retrial is ordered.

Justice Kevin Zervos grants leave for Mr Ma to appeal. The DoJ objects to admission of the transcript of Ma's original successful application for reversal of his guilty plea after he changed lawyers. Zervos overrules this as it is "relevant to the consideration of whether there has been a miscarriage of justice."
