Justice Andrew Chan slams the ex-CE for failure to cooperate with the ICAC despite public promises to do so. 1/3 of an estimated HK$15m of prosecution costs in trial 1 are awarded against him. After conviction for misconduct in public office and a hung jury on a bribery charge, he was tried again on that charge and the new jury hung again. It now emerges that in an attempt to influence the jury in trial 2, a PR firm or consultant rustled up the great and good to sit in a reserved section of the public gallery. We note that many of them are the same staunch Catholics from across the political spectrum who attended a church service to pray for him after his conviction. Amongst the congregation was CE-elect Carrie Lam, who now has the power to pardon him.

Scrap the public float rule
Investors in SCMP (0583) are in the deep freeze again, and other companies have indulged in artificial schemes to comply with the 25% public float rule. The rule should be scrapped, because as we explain, it has no real purpose, and because the only way to enforce it is to victimize minority shareholders by suspending their shares. David Li Kwok-po, who has been "independent" non-exec director of COLI for nearly 21 years since its IPO, is succeeded by his son, Brian David Li Man-bun. Their Bank of East Asia has been a banker to COLI since the IPO too, so the business relationship makes them non-independent in our view.
