Justice Michael Hartmann: "the HSBC Group itself has a global reputation...which no doubt it will seek most jealously to guard" - and so he allows HSBC Trustee to use a fellow subsidiary as asset manager of the Robert Ho Tung Charitable Fund - keeping it all in the family, against the objections of the Secretary for Justice to the possible conflict of interest.

The trustee makes elaborate arrangements to avoid HK Estate Duty on the future death of Robert Ho Shai Lai, involving the establishment of a Unit Trust with a Nauru Trustee and a Jersey Trustee holding all but 2 of the units. Just the HK assets amount to US$70m, including US$55m of real estate.
